Terms and Conditions

These Terms and Conditions ("Terms") govern your use of culio.co, the early access form, demo bookings and related communication (together, the "Site"). The Site is operated by Bhyte Software, the company behind Culio ("Culio", "we", "us" or "our").

By using the Site or submitting the early access form, you agree to these Terms. If you use the Site on behalf of a business, you confirm that you are authorised to accept these Terms for that business. If you do not agree, do not use the Site.

Culio is an AI customer communication platform in development. It is designed to help businesses answer customer questions, qualify leads, book appointments and follow up across WhatsApp, Instagram and their website. Descriptions of Culio on the Site, including our roadmap, describe what we plan to build. They are not a promise that any particular feature will be available, or available by a particular date.

You must be at least 18 years old and able to enter into a binding agreement to use the Site. Culio is intended for businesses and professionals, not for personal or household use.

Submitting the early access form adds your business to our list of interested businesses. It does not create a customer relationship, reserve a price, or guarantee that you will receive access.

• We choose early access participants at our discretion, for example based on business category, location and launch capacity.
• Access to the Culio platform, if offered, will be governed by a separate customer agreement that you will be asked to accept at that time.
• We may change, pause or end the early access programme at any time.

You agree that the information you give us is accurate, current and your own or your business's to share. Do not submit another person's contact details without their permission.

How we handle personal data is explained in our Privacy Policy, which forms part of these Terms.

If you agree on the early access form, we may contact you by email, phone call, SMS or WhatsApp about early access, onboarding and demos. Standard message and data rates from your carrier may apply. You can opt out at any time by replying STOP to a WhatsApp or SMS message, using the unsubscribe link in an email, or contacting us at contact@culio.co.

When using the Site, you must not:

• submit false, misleading or automated form entries, or spam;
• break any applicable law or infringe anyone else's rights;
• try to gain unauthorised access to the Site, our systems or other users' data;
• interfere with or disrupt the Site, including by introducing malware or overloading our infrastructure;
• scrape, copy or reverse engineer the Site except as allowed by law.

We may remove submissions and block access to the Site if we believe these rules have been broken.

The Site and its content, including the Culio name, logo, design, text and graphics, are owned by Bhyte Software or its licensors and are protected by intellectual property laws. You may view and share pages of the Site for your own business evaluation of Culio. You may not otherwise copy, modify, distribute or use our content or trademarks without our written permission.

If you send us ideas, suggestions or feedback about Culio, you allow us to use them to improve our products without any obligation to you. We will not publicly identify you or your business as the source without your permission.

The Site uses or links to third-party services, such as demo scheduling, WhatsApp and social media platforms. Those services are governed by their own terms and privacy policies, and we are not responsible for their content or practices.

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, about the Site, including that it will be uninterrupted, error-free or secure, or that information on it is complete or up to date. Nothing on the Site is legal, financial or other professional advice.

To the fullest extent permitted by law, Culio and Bhyte Software will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of or inability to use the Site.

Because the Site is provided free of charge, our total liability for any claim relating to the Site is limited to one hundred US dollars (USD 100). Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud.

You agree to compensate us for reasonable losses and costs, including legal fees, arising from your breach of these Terms or your misuse of the Site, to the extent permitted by law.

We may change or discontinue any part of the Site at any time. We may also update these Terms. The updated Terms will be posted on this page with a new date at the top, and will apply from the time they are posted. If you keep using the Site after that, you accept the updated Terms.

These Terms are governed by the laws of the Republic of Ghana. The courts of Ghana will have jurisdiction over any dispute arising from these Terms or the Site, unless the mandatory law of your country gives you the right to bring proceedings elsewhere.

If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not transfer your rights under these Terms without our consent. These Terms and our Privacy Policy are the entire agreement between you and us about the Site.
